Purport of claim and appeal

1. The following facts can be acknowledged in full view of the following facts: (a) there is no dispute between the parties; (b) the entries in Gap evidence 1 to 10; and (c) the results of the return of financial transaction information to Korean banks, a stock company of the first instance court.

Around March 6, 2000, the Defendant applied for membership with a credit card member with Korea Light Bank, a corporation around that time, and delayed payment of the above credit card payment claim from September 24, 2001 while being used with a credit card issued by the above bank from that time.

B. Light Bank Co., Ltd. filed a lawsuit against the Defendant as Seoul District Court Branch 2001Gadan19025, and on December 4, 2001, the above court issued a performance recommendation decision with the purport that “the Defendant shall pay the Defendant 4,870,665 won to Korea Light Bank and 4,648,215 won, calculated at the rate of 24.5% per annum from November 23, 2001 to the date of full payment,” and the above performance recommendation decision was finalized on January 3, 2002.

C. Since then, Korea Light Bank, Inc., changed its trade name to Korea Bank, and Korea Bank, around October 24, 2003, transferred to Korea LG Investment Securities Co., Ltd., and on the same day, LG Investment Securities Co., Ltd., to the Plaintiff the above credit card payment claim against the Defendant (hereinafter “the instant credit card payment claim”).

On December 18, 2003, the Plaintiff notified the Defendant of the transfer of credit card payment claim of this case by content-certified mail with the power to notify the assignment of credit by delegation of the right to notify the assignment of credit by order from our bank and LG investment securities company.

E. The details of the instant credit card payment claim against the Defendant that the Plaintiff acquired through the LG Investment Securities Co., Ltd. from the KG Investment Securities Co., Ltd. are the principal amounting to KRW 4,648,215 as of October 30, 2003, KRW 815,171 as of October 30, 200, KRW 1,717,176 as of the transfer, and KRW 100,400 as of the transfer.
