[Defendant A] The defendant shall be punished by imprisonment for one year.
However, for two years from the date this judgment becomes final and conclusive, the above sentence shall be executed.
Reasons
Punishment of the crime
1. On April 20, 2014, Defendant A, who took part in the part of the members of the criminal organization of the “Singing” criminal organization and conspired in order to pay money to the account opened in the name of another person by the victims, which is subject to the deception of a person who was not killed in the name of another person. Around April 20, 2014, Defendant A conspired to take charge of withdrawing money.
As above, the Defendant acquired the means of electronic financial transactions in collusion with those under the name of the victims, such as E, on two occasions as follows.
(1) On April 24, 2014, around 13:30 on April 24, 2014, the Defendant: (a) received post office accounts opened in F name with a nameless box; (b) a post office account; (c) a new bank account; and (d) a post office account opened in the name of Busan Bank account; and (c) a post office account opened in G name with a nameless box.
(2) On February 24, 2014, around 16:05, the Defendant received the cash card of the Agricultural Cooperative account opened in the name of H and 203 mail boxes at Silung-si, and the passbook and check card from the account of community credit cooperatives opened in the name of No. 1. 1.
B. As above, the criminal defendant, in collusion with the victims of the E, etc., acquired property from the victims on two occasions as follows.
(1) On April 24, 2014, at around 15:09, in accordance with the above solicitation, the Defendant sent false messages to the F’s post office account in the name of F that “it is impossible for the victim to make payment due to an error on five occasions,” and instead, the Defendant sent KRW 2,150,000 to the said account at around 15:20 on the same day from the victim’s 15:20 on the same day.”
(2) On April 24, 2014, a person who was unaware of the name of the above criminal organization, according to the above conspiracy.
