Defendants shall be punished by a fine of KRW 5,000,000.
In the event that the Defendants did not pay the above fine, each of them is 100.
Reasons
Punishment of the crime
1. Except as otherwise expressly provided for in any other Act, no person who intends to use or manage an electronic card used for electronic financial transactions, electronic information equivalent thereto, a certificate, a password, or any other access medium shall lend any access medium while demanding, demanding, or promising to provide, demand, or promise the consideration;
Nevertheless, the Defendant, at the end of May 2017, received contact from his name-free person to lend a passbook of KRW 300,000 per day to the Kakao Stockholm message, and consented thereto, and thereafter, this part of the indictment stated “after receiving contact with 60,000 won per month in which he sent the Kaka card, and consenting thereto,” but this appears to be a clerical error. However, even if it was corrected without any amendment to the indictment, it does not seem to be a substantial disadvantage to Defendant A’s exercise of his right to defense, and thus, the indictment shall be corrected ex officio.
In E.S., E.S. 3 apartment complex in E.S. Daegu Dong-dong-gu, E.S., the defendant sent the physical card to the name in the name in the name in Kwikkset Service and lent the password to the third apartment complex of E.S. and the access media of E.S. in the electronic financial transactions.
