The defendant's appeal is dismissed.

1. The decision of the court below on the gist of the grounds of appeal (the imprisonment without prison labor for eight months, the suspension of the execution of two years, the community service order 80 hours, the order to attend a lecture 40 hours) is too unreasonable.

2. On the other hand, the accused is against the confession of the facts charged, and the accused does not want the punishment of the accused by agreement with the bereaved family members of the victim, and the vehicle driven by the accused is covered by a comprehensive insurance.

However, in full view of the various circumstances, such as the death of the mother of a family due to the instant accident, the lower court’s punishment is unlimited and unreasonable, in view of the following circumstances, including the Defendant’s age, environment, sex, and circumstances after the commission of the crime.

3. The defendant's appeal is without merit. Thus, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act. It is so decided as per Disposition.
