A defendant shall be punished by imprisonment for not less than eight months.

The defendant 730,00 won to E who applied for compensation, and 690,000 won to D who applied for compensation.

Punishment of the crime

Around February 28, 2018, the Defendant posted a false statement to the effect that “The Defendant would send the said goods to the victim E who contacted the suspect,” despite having no intent or ability to send the goods to the victim even if he/she received the payment of the goods from the victim,” thereby making it false to the effect that “The Defendant would send the said goods if he/she transfers the money.”

Around March 1, 2018, the Defendant received 730,000 won from the victim to the corporate bank account (H) in the name of the Defendant as the price for the goods. Around that time, from around March 1, 2018 to March 20, the Defendant received a total of KRW 5,961,000 from the victims over 11 times in the same manner as shown in attached Table 1.

Accordingly, the defendant was provided property by deceiving the victims.

Around June 25, 2018, the Defendant posted a false statement to the effect that “The Defendant would send the said goods if he/she transfers money to the Defendant,” even if he/she did not have the intent or ability to deliver the goods to the victim,” and that “The Defendant would sell the goods to the Defendant,” on the Internet FG car page bulletin,” and that “The Defendant would send the said goods if he/she transfers money to the Defendant.”

Around June 25, 2018, the Defendant received KRW 345,00 from the victim to the K account (L) in the name of the Defendant, and received KRW 5,136,000 from the victims four times in total in the same manner as shown in the attached crime list 2 from around that time to August 30, 2018.

Accordingly, the defendant was provided property by deceiving the victims.
