A defendant shall be punished by imprisonment for six months.

Punishment of the crime

[2015 Highest 2894] On June 17, 2014, the Defendant made a false statement to the victim D's house of the victim D, C apartment 409, 701, at the time of Chungcheongbuk-gu, Chungcheongnam-si, 2014, stating that the Defendant “on the face of lending his or her husband and wife’s expansion fund to operate the department store new store in Seoul, he or she will repay the term “on the face of lending his or her husband and wife’

However, the facts are as follows: (a) the Defendant joined more than 10 fraternitys at the time and received them first; (b) again paid interest on the loans of KRW 5 million per month and KRW 1 million per month; and (c) the Defendant’s monthly income is less than KRW 1.5 million; and (d) even if there is no particular property, there was no intention or ability to repay the extended amount with the repayment from the injured party.

The Defendant received 9.5 million won from the injured party to the Nonghyup Bank account (the No. 1) in the name of the Defendant under the name of the said party as a loan on the same day.

During the period from July 1, 2013 to October 15, 2014, the Defendant received a total of KRW 34,100,000 from the victims in five times in total, as indicated in the list of crimes in the attached Form.

Accordingly, the defendant was informed of the victims to receive property.

[2015 Highest 3844] On September 1, 2014, the Defendant loaned the victim H with the “G” bath located in the “G” in the Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-do. “I wish to pay back the time limit immediately if I lent KRW 7 million to the victim H because there is a shortage of money to carry out oral funeral.”

However, at the time, the Defendant was in the situation where he received demands for the payment of the interest amounting to about KRW 70 million from I, D, and nameless bonds companies, etc., and even if he borrowed money from the damaged person, he did not have the intent or ability to use such money as operating funds of the wharf operated by his wife.

Nevertheless, the defendant shall make such a false statement, and seven million won on the same day from the injured party, and on the 5th day of the same month.
