A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for a period of four years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant became aware of the victim E (the 16-year-old age), a juvenile, who is a child of the interest of the patient of the above hospital, while receiving hospitalized treatment at the hospital D located in Gyeonggi-si.

피고인은 2016. 1. 2. 경 경기 군포시 F에 있는 G 병원 811호에서, 위 피해자가 누워 있던 침대 위로 올라가 피해자에게 ‘ 잠시만 있어 봐 ’라고 말하며 손을 피해 자의 옷 안으로 집어넣어 피해자의 가슴 부위를 만지고, 이에 ‘ 하지 말라’ 고 말하는 피해자에게 ‘ 조용히 해 ’라고 말한 다음 입으로 피해자의 가슴 부위를 깨물며 손으로 피해자의 음부를 만지다가 손가락을 피해자의 음부에 집어넣었고, 피해자의 바지를 벗기고 피해자의 다리를 올린 다음 입을 피해자의 음부에 갖다 댔으며, 계속하여 자신의 바지를 벗은 다음 손으로 피해자의 머리 부위를 잡아 자신의 성기를 피해 자의 입에 집어넣은 채 수 회 눌렀고, 피해자를 침대 위에 눕히고 자신의 성기를 피해자의 음부에 삽입하여 1회 간음하였다.

Accordingly, the defendant had sexual intercourse with a child juvenile by force.
