1. The Defendant (Counterclaim Plaintiff) against the Plaintiff (Counterclaim Defendant)

A. Attached 2 Map 1, 31, 31, among the area of 8,778 square meters in Sacheon-si C orchard.

A principal lawsuit and a preliminary counterclaim shall be deemed simultaneously.

1. Basic facts

A. On June 19, 2013, the Plaintiff purchased 1,630 square meters (hereinafter “instant Plaintiff’s land”) from Nonparty F and completed the registration of transfer of ownership. The Defendant is the owner of the instant land, which is located adjacent to the instant land owned by the Plaintiff, of the C orchard C, C, orchard 8,778 square meters (hereinafter “instant land”) and the 225 square meters prior to D (hereinafter “D”) in each of the instant land.

B. The G forest land G 74,777 square meters was owned jointly by Nonparty H and three other persons. On August 1, 1994, G forest land was divided into 14,941 square meters, 15,358 square meters of G forest land, 11,543 square meters of J forest, 32,935 square meters of K forest, and 32,935 square meters of K forest. On the same day, L, a husband of the Defendant, completed the registration of ownership transfer for the said I forest land 15,358 square meters (hereinafter “I land before the instant division”).

C. On October 1, 2005, the registration of ownership transfer was completed in the name of Nonparty M on October 1, 2005 with respect to the I forest before the instant partition, and the registration of ownership transfer was completed in the name of the Defendant on July 15, 201.

On October 14, 2011, the said I Forest was divided into 6,850 square meters of I Forest and 6,850 square meters of N Forest and 8,508 square meters of N Forest, and the said N Forest became subject to registration conversion on October 17, 201.

L around 199, around 199, connected each point of the attached Table 2 drawings Nos. 1, 31, 32, 33, 34, 4, 5, 35, 36, 30, and 1 in sequence among the land in this case, L was used as the combined map Nos. 11, 42, 43, 44, 45, 46, 47, 48, 49, 50, 51, 52, 53, 54, 55, 56, 57, 58, 59, 60, 61, 62, 62, 10, 10, and 11 as the combined map No. 63 square meters and the combined map No. 11, 42, 437, 414, 341, 304, and 114.

E. The Plaintiff’s land is the instant case with a view to entering the land as a franchising and meritorious road.
