Defendant shall be punished by a fine of KRW 1,500,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
The defendant is the actual representative in B and C in the 1st floor in light name, who runs a restaurant by employing two full-time workers.
1. When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;
Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.
Nevertheless, the Defendant did not pay the statutory holiday allowances from May 7, 2018 to May 3, 2019 to KRW 693,00 during the period from April 22, 2019 to May 3, 2019, and the total amount of KRW 517,750 during the period from April 5, 2018 to May 3, 2019 to May 3, 2019 to KRW 517,750 during the period from May 3, 2018, and KRW 517,750 during the period from May 3, 2018 to April 5, 2018 to May 3, 3, 2019 to KRW 2,946,00,3,463,750 within 715 days from the date of the retirement agreement, respectively, within 4,516 days from the date of the retirement agreement.
2. When a worker retires, the employer shall pay the retirement allowance within fourteen days after the cause for such payment occurred; and
Provided, That the date of payment may be extended by an agreement between the parties in extenuating circumstances.
Nevertheless, the defendant did not pay the retirement pay KRW 1,399,783 of the retirement worker E within 14 days from the date of retirement without an agreement between the parties to the extension of the due date.
3. An employer shall clearly state wages, contractual work hours, holidays under Article 55 of the Labor Standards Act, annual paid leaves under Article 60, and other working conditions prescribed by Presidential Decree to workers when concluding an employment contract, and shall deliver written statements specifying the constituent items, calculation method, payment method, contractual work hours, holidays under Article 55, and annual paid leaves under Article 60 to workers;
Nevertheless, the defendant at the above workplace on April 2018.
