A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

On March 2013, the Defendant established a stock company E in the name of around D and received investment in the victim F under the pretext of solar power generation business.

1. On February 2, 2013, the Defendant defraudeded KRW 30 million on the log funds, thereby making a false statement to the effect that “The Defendant, at the coffee shop located in Seocho-gu Seoul Metropolitan Government Yang Jae-dong, installed solar devices on the roof of G, which is a KOSDAQ company, and was in need of KRW 30 million as working expenses to establish and operate solar companies, and can recover if the contract is two to three months.”

However, in fact, the Defendant was entirely unable to have assets, technology, and equipment for solar power generation projects, and there was little possibility of success due to the absence of a business entity, such as the contract being in progress, and even if he was paid KRW 30 million from the injured party, he was thought to have immediately returned from H without using it as the street funds and make personal consumption thereof. The KRW 11 million delivered to H was returned to him by June 2013, and he had no intention or ability to return it to the injured party in the event of a non-business operation.

On March 4, 2013, the Defendant received from the injured party a transfer of KRW 30 million from the account in the name of the closed-end bank in the name of the closed-end bank.

Accordingly, the defendant was given property by deceiving the victim.

2. J Housing Association-related borrowing funds 20 million won, defraudedation Defendant is guilty of the victim’s “J reconstruction apartment housing association, which is implemented by K, is well-known, because it is connected to K when reconstruction is implemented,” and “20 million won can be collected to the housing association.”
