1. Defendant C, D, E, F, and G are the corresponding shares in the attached Table 2 among the real estate listed in the attached Table 1 list to the Plaintiff.
Reasons
1. Inheritance relation with I's property (applicable: Each entry in Gap's evidence 1, 4, and 11 (including paper numbers);
A. The heir at the time of the I’s death (as of March 29, 1969) (as of March 29, 1969): Defendant B (mas and girls, son and girls of the South Korean J (as of May 31, 1960)), K (C) and Defendant G (as of May 31, 1960), and Defendant H (M).
The heir at the time of the death of K ( January 16, 1979): Defendant C (spouse), Defendant D, E, or F (F).
For the same reasons, the Defendants inherited or successively inherited the assets of I in proportion to their respective shares listed in the separate sheet No. 2; 2. Claim against Defendant C, D, E, F, and G
A. A house listed in the attached list 1 indicating the claim (hereinafter “instant house”) was owned by I.
The plaintiff purchased the housing of this case from the heir on April 7, 1969, after I's death.
Therefore, the above Defendants (However, Defendant C, D, E, and F are obligated to implement the registration procedure for transfer of ownership based on the sale on April 7, 1969 with respect to each of the instant shares of inheritance (each of the corresponding shares listed in the attached Table 2) among the instant housing to the Plaintiff upon K’s death.
(b) Defendant C, D, E, or F: Judgment by deeming confession (Article 208(3)2 of the Civil Procedure Act)
(c) Defendant G: Judgment by public notice (Article 208 (3) 3 of the Civil Procedure Act);
3. Claim against Defendant B and H
A. Main Claim: The plaintiff alleged that the above defendants sold the house of this case to the plaintiff on April 7, 1969. However, since the above defendants did not know the facts of the plaintiff's assertion explicitly, it is difficult to recognize the above facts of assertion only with the evidence of the plaintiff's submission. Thus, this part of the plaintiff's assertion is without merit.
B. Preliminary Claim: In full view of the entries in Gap evidence No. 3 and the purport of the entire pleadings, it can be recognized that the plaintiff occupied the house of this case from February 13, 1971 (the date of acquisition of ownership of the building site of this case) and that the plaintiff occupied the house of this case until the closing date of pleadings of this case.
