1. The Defendant’s KRW 157,325,905 as well as 5% per annum from July 19, 2017 to October 16, 2019 as to the Plaintiff.

Basic Facts

The Plaintiff loaned KRW 143 million on May 30, 2012, and KRW 287 million on October 18, 2012, respectively, to the Defendant for purchase of land C, D, E, and building on its ground (hereinafter “instant real estate”). On behalf of the Defendant, the Plaintiff spent KRW 74,749,300 on a total of KRW 74,749,30 on behalf of the Defendant, including acquisition tax, registration cost, and fire insurance premium.

The Plaintiff received KRW 310 million from the Defendant around June 15, 2012 with the repayment of the above loans, etc. and the loan from the Defendant.

[Based on the facts acknowledged by the plaintiff himself/herself or without any dispute, the statements in Gap 4, 5, 7, and 8 evidence, the purport of the entire pleadings, and the purport of the court's determination as to the plaintiff's grounds for the plaintiff's claim, barring any special circumstance, the defendant is obligated to pay to the plaintiff the above loans and claims for indemnity (= KRW 504,749,300,000,000,000 KRW 287,749,300,000,000,000 KRW 194,749,30,000,000,000 for the above loans and claims for indemnity (= KRW 504,749,300,000,000 for KRW 31,749,300,000 for loans, etc.) and damages for delay.

The defendant's assertion as to the defendant's counterclaims set-off of set-off is as follows: (a) on March 6, 2013, KRW 100 million in cash; (b) on May 10, 2013, KRW 100 million in the bank account of F, an employee of the plaintiff, KRW 20 million (the defendant's KRW 80 million, KRW G, KRW 20 million); and (c) on May 16, 2013, KRW 100 million in the bank account of H, the plaintiff's wife (the defendant's KRW 88 million, KRW I, KRW 12 million, and KRW 300,000,000,000,0000,000,000,000 from October 25, 2012 to July 21, 2016, the plaintiff arbitrarily transferred the real estate of this case to the defendant from the lessee's deposit and rent to KRW 280,51681.5 million.
