Defendant shall be punished by a fine of KRW 2,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

No person may provide telecommunications services provided by a telecommunications business operator for any third person's communications.

On November 1, 2015, the Defendant: (a) prepared and delivered a letter of delegation, a confirmation of attention to opening of a mobile phone, and a confirmation document on transactions of a mid and long-term mobile phone to D employees of “C” in Daejeon-gu Daejeon for the purpose of obtaining a loan at a coffee shop located in Chungcheongnam-gu, Chungcheongnam-gu, Daejeon; (b) entrusted all opening and disposal of the mobile phone; and (c) on November 10, 2015 and November 11, 2015, at the above C office, the said C employees, such as D, made a written application for subscription to the mobile phone under the name of the Defendant using the documents provided by the Defendant and opened the mobile phone, and provided telecommunications services provided by the telecommunications business operator for the purpose of communications by having another person sell them to the latter.

That as long as a defendant delegates opening or disposal of a mobile phone in the name of the defendant to another person by preparing and issuing a letter of delegation, a certificate of intention to open or deliver a mobile phone for the purpose of obtaining loans, and a document of confirmation of transactions of a used mobile phone, the defendant was unaware of the opening or disposal of the mobile phone;

Even if there is a violation of the Telecommunications Business Act.

Application of Statutes

1. Article 97 Subparag. 7 and Article 30 of the Telecommunications Business Act and the selection of fines for criminal facts;

1. The former part of Article 37 of the Criminal Act, and Articles 38 (1) 2 and 50 of the same Act, which aggravated concurrent crimes;

1. Articles 70(1) and 69 of the Criminal Act to attract a workhouse.
