1. The defendant shall pay to the plaintiff the amount of KRW 77,172,080 and KRW 46,927,034 from November 7, 2019 to the day of full payment.
Reasons
1. Determination on the cause of the claim
A. On April 28, 2016, D Co., Ltd. loaned a loan of KRW 30 million to the Defendant at the rate of 12 months, interest rate of 27.7%, and overdue interest rate of 27.9%.
(hereinafter “First Loan”). In addition, on September 22, 2016, E Co., Ltd. loaned a loan of KRW 18 million to the Defendant at the rate of 60 months, interest rate of KRW 21%, and overdue interest rate of KRW 27.9%.
(hereinafter referred to as "second loans"). (b)
D A. On August 10, 2017, and on August 31, 2017, E transferred the claim for the first and second loans to each stock company F.F. on August 31, 2017, and notified each Defendant of the assignment of the claim.
C. On July 31, 2018, F Co., Ltd. transferred its claim for loans Nos. 1 and 2 to the Defendant to the Plaintiff, which had completed the registration of credit business, and notified the transfer of the claim at that time.
As of November 6, 2019, each of the above claims against the Plaintiff against the Defendant remain:
[Unit] The fact that there is no dispute over the interest accrued until August 1, 2018 of the remaining principal and interest accrued until August 2, 2018, as the aggregate of interest accrued after August 2, 2018 30,00,000,820,847 10,594,596 51,415,203 2,034 2,852,852, 1435,97, 7025,75,76,877 25, and 5 (including each number), and the purport of the entire pleadings as the whole.
2. According to the facts of the determination as to the cause of the claim, the defendant is obligated to pay to the plaintiff the amount of KRW 77,172,080 (the amount of KRW 51,415,203 + the amount of principal and interest of KRW 25,756,87) and the principal amount of KRW 46,927,034 (the amount of KRW 30,00,000 + the amount of principal and interest of KRW 16,927,034 + the amount of principal and interest of KRW 16,927,034) from November 7, 2019 to the date of full payment.
3. Conclusion, the plaintiff's claim of this case is justified, and it is so decided as per Disposition.
