A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Reasons
Punishment of the crime
On March 2012, the Defendant: (a) supplied raw materials necessary for the supply of the above equipment to D, in order to provide cooperation, ventilation, and studio equipment supply work among the new construction of the above equipment, by telephone at the D office operated by the Defendant in Chuncheon-si, the Defendant: (b) decided to pay the raw materials from the victimized Company to pay each month; (c) decided to pay each month; and (d) decided to pay the price of the supplied materials from the victimized Company to pay each time on January 7, 2013; and (d) decided to pay the price of the supplied materials and made and continue to be supplied the raw materials.
On May 30, 2013, the Defendant entered into a contract for the alteration of supply of equipment with G Co., Ltd. to reduce the construction cost of the said equipment from 5.4 billion to 3.2 billion won. At the time, the said construction has already incurred about KRW 400 million due to the said construction work, and the damage has already been incurred even in the new World Plastal Plet Corporation and I hotel construction, and there was no intention or ability to pay the price for supply even if the said equipment is supplied with the raw materials from the victim.
Nevertheless, around May 2013, the Defendant issued an order to supply raw materials to the damaged company.
The Defendant, as such, by deceiving the victim, received from the victim the raw materials worth KRW 6,173,280, a total market price of KRW 6,173,280, around June 5, 2013, and received supply of raw materials worth KRW 39,89,49, in total from that time until July 11, 2013, from that time, from that time, until July 11, 2013.
