Reasons
1. Details of the disposition;
A. The Plaintiff A Co., Ltd. (hereinafter “Plaintiff”) is a company producing storage cells, etc., and Plaintiff B is the former representative director of the Plaintiff Co., Ltd., and the Defendant was designated as a “other public institution” pursuant to Article 5 of the Act on the Management of Public Institutions (hereinafter “Act on the Management of Public Institutions”) and was changed on January 24, 201 to a “market-type public corporation” under Article 2011-1 of the Ministry of Strategy and Finance notification pursuant to Article 6 of the Act on the Management of Public Institutions.
B. On February 25, 2009, the Plaintiff Company entered into a contract with the Defendant for the supply of goods with a contract amounting to KRW 3,674,00,00 with respect to the storage batteries and bags (the steel mold containing storage batteries) to be used in the reported nuclear power plant C, and subsequently entered into a contract for the alteration of the terms of contract amounting to KRW 3,743,141,710 on November 11, 201 (hereinafter “instant contract”).
C. On July 2012, the Plaintiff Company supplied storage batteries and bags to the Defendant, and submitted to the Defendant a certificate of material quality (hereinafter “instant test report”) on September 3, 2010 in the name of the scco special steel company (hereinafter “scisco special steel company”) with respect to steel plates (HR COL, size 2.3T iron plates, size 2.3T, and size 1T =1m; hereinafter “scisco”). Since then, the Defendant confirmed that the instant test report was forged, followed by deliberation by the Special Contract Deliberation Committee on January 21, 2014, and on February 24, 2014, Article 39 of the Public Institutions Operation Act and Article 15(1) and (4) of the former Rules on Contract Affairs of Public Corporations and Quasi-Governmental Institutions (amended by Ordinance of the Ministry of Strategy and Finance No. 375, Nov. 18, 2013; hereinafter “former Rules on Contract Affairs of Public Corporations”).
