Defendant shall be punished by a fine of KRW 700,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
A. At around 06:00 on December 17, 2018, the Defendant: (a) obtained one copy of the national card owned by the victim B, which was damaged by the victim B, in front of the middle dynamics of the river basin located in Seocheon-si, and did not take necessary procedures, such as returning the card to the victim; (b) embezzled the property that he/she had thought to have, and without taking necessary procedures; and (c) embezzled the property that he/she left the possession.
B. On December 18, 2018, the Defendant: (a) around 06:06 on December 18, 2018, at the convenience store operated by the victim D located in Bupyeong-si, Seocheon-si, the Defendant provided 4,500 won or more by presenting the national card (E) acquired as above to his card-holder-holder-holder-holder-employee to settle the accounts; (b) around 06:06 on December 19, 2018, the Defendant provided 4,500 won or more by having the employee settle the accounts; and (c) around 06:06 on December 19, 2018, the Defendant purchased the national card (E) acquired as mentioned in the above paragraph (A) within the convenience store operated by the victim D located in Seocheon-si, Seocheon-si, 200 won or more by having the employee who was the card-holder pay the amount of KRW 4,500 won or more.
3) On December 19, 2018, at around 06:07, the Defendant: (a) presented the national card (E) acquired, such as the above (E) within the convenience store operated by the victim D located in Seocheon-si, Seocheon-si; (b) obtained property benefits equivalent to KRW 4,500 by having his card merchant pay to his card merchant; (c) around 16:19, Dec. 20, 2018; and (d) obtained the national card (E) within the H convenience store operated by the victim G located in Seocheon-si, Seocheon-si, Seoul; and (d) obtained the national card (E) within the market price of KRW 3,800,00 by presenting it to his card merchant, thereby making the employee settle it.
