A defendant shall be punished by imprisonment for two years.

Punishment of the crime

The defendant is a director of D (hereinafter referred to as "D") who is a corporation for the purpose of sale, etc., such as daily necessities and health auxiliary food in Busan Jin-gu C.

1. Fraud;

A. On June 2012, the Defendant, in the name of the purchase price of stocks, recommended the Victim E to purchase the D shares at KRW 2,000 per share, stating that “At the early 2,00 won per share of the D shares was 50 won per share, and now the price was 2,000 won per share. D shares will not be listed on the KOSDAQ market, but will be listed on the KOSDAQ after about one year. At the time of listing on the KOSDAQ, the purchase of the D shares at KRW 2,00 per share will be KRW 10 per share.”

However, the fact was that the Defendant had previously been demanded to repurchase (State) stocks sold to others, such as F, and was unable to repay the debt of KRW 00 million that was borrowed from the stock purchaser. Since (State)D’s business performance was insufficient, it was listed at the KOSDAQ market or there was no possibility that (State)D could distribute its profits to shareholders after one year.

As above, the Defendant: (a) had the victim E by deceiving the victim E; (b) sold KRW 1,500 stocks of D around June 15, 2012 to the victim E; and (c) received KRW 3,000,000 from the purchase price to the bank account in the name of Korea (State) bank account in the name of D; and (b) had the victim deceiving him by the same method as shown in the list of crimes (1) between July 10, 2012; and (c) had the victim received KRW 29,00,000 from the victims as the purchase price of shares.

B. On August 2012, the Defendant, in the name of money invested, will leave the victim H as a consumption cooperative, which is a government policy, at the above State D office, and at the victim H.
