A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

After purchasing only USIM chips from a mobile phone dealer, the Defendant and C connected the Internet game site as if the registered titleholder of the smartphone chips were used normally by inserting them into the smartphone machine in possession. After purchasing the game items, the game items were purchased and the cost of purchasing the game items was imposed on the registered titleholder of the core chips as the mobile phone information service fee, and the purchased game items were sold to other persons for money.

Around October 2014, the Defendant and C conspired to put the mobile phone core chips in the name of the victim F purchased from 401 of the Gangnam-gu Seoul D Building No. 401 and the name of the largephone distributor E, and then had access to the Internet game site as if the victim F were normally used by the Defendants. After purchasing the amount equivalent to KRW 1,045,90,00, the amount was imposed as the victim F's information usage fee. The Defendant and C acquired the financial benefits equivalent to KRW 1,045,90 by entering the false information or improper order into the information processing device, such as computer, or inputting or altering the information without authority.

The Defendant and C conspired with each other from October 2014 to March 2015, the victim 56 persons purchased from one E from around October 2014 to March 2015 using the chip as described in the separate crime list, and acquired a total sum of 49,493,822 won by purchasing game items by entering false information or improper orders into a computer or any other information processing device or inputting or altering information without authority, as if the victims purchased the game items, and allowing the victims to use the chip to enter them into the game site using a mobile phone, and thereby making the victims obtain financial benefits equivalent to 49,493,822 won.
