A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date of the final judgment.

Punishment of the crime

1. On July 23, 2014, the Defendant causing property damage: (a) around 13:20 on July 23, 2014, the victim D’s house located in nutrition C, called “didly telephone nickno”, and damaged the victim’s glick door so that the victim was called the E-cafeteria where the Defendant was the victim’s house at the time of the victim D’s house located in nutrition group C, by paying the immediately preceding drinking value, and called the Defendant’s home.

2. 폭력행위등처벌에관한법률위반(집단흉기등상해) 및 특정범죄가중처벌등에관한법률위반(보복상해등) 피고인은 2014. 7. 23. 21:20경 영양군 F에 있는 피해자 D이 운영하는 G주점 1층홀에서 위 재물손괴에 대하여 피해자의 남편인 H이 경찰에 신고하였다는 이유로 화가 나 피해자에게 “이 씨발년아 또 신고해 봐라, 죽여뿐다”라고 말하며 왼손으로 피해자의 목을 잡고, 오른손으로 피고인의 집에서 가지고 와 미리 소지하고 있던 위험한 물건인 부엌칼(전체길이 34cm , 칼날길이 20cm )을 들고 피해자의 가슴 부위를 향해 겨누면서 “씨발년 낮에 신고했지. 감히 니가 나를 건드려. 씨발년 영양바닥에서 많이 놀았는갑지. 영양바닥에 날 갈불 놈이 어디 있어. 내가 깜방 갔다가 나와서 식구들 다 죽여뿐다.”라고 말하고, 이에 종업원 I이 피고인의 오른손을 잡고 제지하자 이를 뿌리치면서 들고 있던 위 부엌칼로 피해자의 오른쪽 눈썹 부위를 긋고, 주먹으로 피해자의 얼굴 부위를 때리고, 피해자를 밀어 넘어뜨려 깨어진 맥주병에 피해자의 엉덩이 부위를 찔리게 하여 피해자에게 약 21일간의 치료가 필요한 눈 주위의 열린 상처 등의 상해를 가하였다.
