1. Defendant A
(a) The defendant shall be punished by imprisonment for three years;
(b)Provided, That the above sentence shall be imposed for a period of five years from the date this judgment becomes final and conclusive;
Reasons
Punishment of the crime
Defendant A, as the representative director of 120 full-time workers, Defendant A of 2015 [Attachment 797], is an employer who runs the manufacturing business of components of a ship using 120 full-time workers.
The Defendant did not pay KRW 4,211,092 of the J’s wages to the said company from September 15, 2014 to May 31, 2015, within 14 days from the date of each retirement, without an agreement between the parties on the extension of the payment deadline.
When a worker dies or retires, the defendant A employer of the 2016 Highest 443th [2016 Highest 443] paid wages, compensations, retirement allowances, and all other money and valuables within 14 days from the time when the ground for such payment occurred, but the defendant was in the position of the head of the quality control division in the management department in the above workplace from December 8, 2008 to September 20, 2015, and on September 21, 2015, he/she was in office as the head of the management department quality control division in the above workplace, and on June 21, 2015, he/she did not pay 1,2,4,5,5,5, 12, 31, 33,05 won every year, including 1,61,746,005 won every day from the date of retirement without agreement on the extension of the payment period between the parties concerned.
