Basic Facts
The plaintiff is a management body organized for the purpose of performing the project on the management of the building of this case and its site and its accessory facilities with all sectional owners as members under the Act on the Ownership and Management of Aggregate Buildings (hereinafter referred to as the "Act on the Ownership and Management of Aggregate Buildings") with respect to the main complex building constructed on both Dongdaemun-gu Seoul and D ground.
On May 28, 2013, the Plaintiff held a management body meeting to appoint E as the Plaintiff’s manager.
On January 7, 2015, the Plaintiff’s management committee decided to establish a corporation and entrust the management of the instant building.
Accordingly, F Co., Ltd. (hereinafter, F) established on March 5, 2015 and entered into a contract with the Plaintiff on July 27, 2015 to be entrusted with the management of commercial buildings among the instant buildings by the Plaintiff.
(hereinafter) On February 24, 2017, the Defendant leased common areas of the first floor above the building of this case from F in KRW 10,000,000, and KRW 2,000,000,000, from the lease deposit money, and operated a marina in the name of “Gart”.
The entrustment contract of this case was terminated on July 31, 2017.
On June 17, 2019, this Court rendered a decision to appoint a lawyer H as a temporary administrator on the ground that the term of office of E has expired.
