1. Case summary

A. 1) The Plaintiff is a learning key, the name of D, “E” in the middle of the circuits between E, and, in accordance with the changes in the low resistance value of black smoke, has shown a negative low-level change. The Plaintiff is a human invention (application number F; hereinafter “instant patent application invention”).

(2) On October 6, 2015, the Korean Intellectual Property Office examiner rendered a decision of refusal on the ground that the instant invention cannot be patented pursuant to Article 29(2) of the Patent Act.

3) On November 5, 2015, the Plaintiff filed a petition with the Intellectual Property Tribunal for a trial seeking revocation of the foregoing decision of refusal (2015 Won6609). On April 19, 2016, the Intellectual Property Tribunal rendered a trial ruling dismissing the Plaintiff’s said decision of refusal (hereinafter “instant trial ruling”).
