A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From June 2016 to July 2016, the Defendant: (a) entered the “C Mart” cocop in the “C Mart” city B and operated the business; and (b) the victim D ( South and 41 years old) is the head of the said Mart.

A special intimidation: (a) around August 30, 2016, at around 18:20 on August 30, 2016, the Defendant doored in C Et to demand the settlement of deposit money for static meat and the payment for static meat sale; and (b) was placed into C Et office to ask for the victims of Mat outside of C in accordance with the reasons for not paying the payment for the settlement.

Accordingly, the defendant carried dangerous objects and threatened the victim.

2. 상해 피고인은 제 1 항 기재 일시, 장소에서 보증금과 정육판매대금을 지급하라는 피고인의 말에 피해자가 아무런 대답을 하지 않자, 피해자의 멱살을 잡아 흔들고 발로 피해자의 정강이를 걷어찼으며, 이어 사무실 안에 설치된 CCTV 카메라를 피해 위 마트 화장실로 피해자를 데리고 나간 후 주먹으로 피해자의 가슴 부위와 뒷목을 수회 폭행하여, 피해자에게 약 2 주간의 치료가 필요한 경추 및 요추 염좌 등의 상해를 가하였다.
