1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Circumstances and details of the disposition;
A. From February 4, 2008, the Plaintiff was appointed as a local public official in the Gunsan-si and was on duty.
1. A public official who has been transferred to the Governor of Jeollabuk-do and worked as a local administrative assistant (Grade VII) belonging to the Public Officials Training Center of Jeollabuk-do;
B. Following the resolution of the Governor of Jeollabuk-do Personnel Committee, the Defendant violated the duty to maintain dignity under Article 55 of the Local Public Officials Act, such as maintaining a different sexual relationship from April 14, 2015 to September 2015 during which the Plaintiff was married, threatening his/her pregnant spouse as dangerous articles, and assaulting the articles, etc. The above acts were subject to the restriction period of promotion (the Plaintiff was subject to a disciplinary measure for 1 month of reduction of salary from April 14, 2014 when driving under the influence of alcohol) and the restriction period for promotion was imposed on the Plaintiff on April 17, 2018 pursuant to Article 69(1)3 of the Local Public Officials Discipline Act, on the ground that the Plaintiff constitutes a misconduct that occurred within one year from April 14, 2014 to May 13, 2015.

On December 19, 2018, the Plaintiff filed a petition review seeking revocation of the instant disposition with the Governor of the Jeollabuk-do Local Appeals Review Committee, but the Governor of the Jeollabuk-do Local Appeals Review Committee dismissed the said claim on February 11, 2019.
① On May 29, 2015, the Plaintiff: (a) known the Plaintiff’s wife during pregnancy and the Plaintiff’s influence problems; and (b) assaulted the Plaintiff’s wife on May 29, 2015, the electric sirens, glass cups, etc.; and (c) displayed a knife on the bet lease where the Plaintiff’s wife was seated on May 29, 2015; and (d) stated, “B would have understood why the couple’s fighting would be destroyed or lost; and (e) it would have caused harm to the life or body of the victim’s wife by carrying dangerous things.
