Punishment of the crime

1. Defendant A is a representative director of a stock company B located in Daegu Metropolitan City North-gu D, and is a person in charge of safety and health management who controls and manages all matters concerning safety and health of its employees and acts for B, a business owner.

(1) When a worker engages in electrical works, such as installation, dismantling, maintenance, checkup, etc. of electric machinery, apparatus, or street at which a electric shock hazard exists, the business owner shall conduct a prior investigation to prevent the danger of workers, record and preserve the results of such investigation, in consideration of the results of the investigation, and shall prepare a work plan including the guidelines for safety work necessary for the situation of the work and have him/her conduct work in accordance with the work plan; and (2) In cases where the worker is likely to be reduced due to his/her work in the exposed charging department or in the vicinity thereof, he/she shall stop the relevant electric route in accordance with the procedure, such as checking whether the work subject to the work has been filled by the inspection electricity before entering the work; and (3) in cases where the worker treats the charging charging station or works in the vicinity thereof, he/she shall wear an automatic protective outfit suitable for the charging station, and (4) in cases where a qualified worker is engaged in work in the vicinity thereof, he/she shall charge the worker with an access to the charging at least 7 mV, except for the relevant electric voltage to the maximum.
