A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On May 24, 2012, the Defendant was sentenced to three years of imprisonment for a violation of the Act on the Protection of Juveniles from Sexual Abuse (Rape, etc.) at the Seoul High Court on May 24, 2012, and completed the execution of the sentence at the Chuncheon prison on June 19, 2014.

On May 24, 2012, the Defendant was sentenced to three years of imprisonment for a violation of the Act on the Protection of Juveniles from Sexual Abuse (Rape, etc.), five years of disclosure of personal information, and five years of order to attach an electronic tracking device at his/her location, and on June 19, 2014, the Defendant is a person who is currently in the period of installation of an electronic device by attaching a location tracking device to the Defendant at the Seoul Northern Protection Observation Office.

[2015 Height 3929] A person with a location tracking device shall not arbitrarily separate the electronic device from his/her body during the period of attachment of the electronic device, interfere with its propagation, alter data received, or otherwise impair its utility.

Nevertheless, the Defendant, around October 31, 2015, damaged by melting the fixed strings and strings of the electronic device into the stringer in the vicinity of Yeongdeungpo-gu, Young-gu, Magdong-si, Magdong-si, and then arbitrarily separated it from the body, and thereby, harming its utility by cutting it into the road along with the portable tracking device.

[2016 Height 123] A person with an electronic tracking device shall not arbitrarily separate the electronic device from his/her body during the period of attachment of the electronic device, interfere with its propagation, alter data received, or otherwise impair its utility.

Nevertheless,

1. Between December 14, 2014 and February 10, 2015, the Defendant, at the time of influencing, damaged the fixed part of the entrance of a fixed studs, which is a part of the conclusion of an electronic device, using tools. On February 10, 2015, at around 22:05, the Defendant was able to arbitrarily separate the fixed studs at the entrance of a fixed studs, which is a part of the conclusion of the electronic device, from the body, and thereby, had the function thereof fulfilled by arbitrarily separating the device that had already been damaged from the body.

2. On January 19, 2015, the Defendant is a portable tracking device for approximately 22 minutes from around 07:56 to around 08:18 on the same day.
