A defendant shall be punished by imprisonment for not less than two years and six months.
Reasons
Punishment of the crime
[2] On June 20, 2008, the Defendant was sentenced to a suspended sentence of 2 months in the Incheon District Court on the following grounds: (a) on September 25, 2009, the Defendant was sentenced to a suspended sentence of 2 months; (b) on October 11, 2013, the Incheon District Court was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes; (c) on January 29, 2015, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes; (d) on April 7, 2016, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at night; and (d) on September 1, 2016, the Incheon District Court was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Incheon District Court; (d) on September 27, 2017.
[Criminal facts] 2018 Highest 5589
1. On June 1, 2018, at around 17:00, the Defendant: (a) stolen the cash equivalent to KRW 40,000,000 in the first floor restaurant in the Seo-gu Incheon, Seo-gu, Seo-gu, Incheon; (b) from around that time to July 22, 2018, the Defendant stolen the property equivalent to KRW 3,525,740 in total amount of damage on 20 occasions, as shown in attached Table 1, from around that time, up to July 2, 2018.
2. On July 14, 2018, at E convenience stores located in Seo-gu Incheon, Seo-gu, Incheon, the Defendant: (a) purchased a three-dimensional Kim Gbl, and (b) presented that he was a legitimate holder with the right to use the stolen bank card as stated in attached Table 117; (c) received the money by settling KRW 2,900; (d) from around that time to July 22, 2018, the Defendant used the stolen bank card by settling the total amount of damages of KRW 1,148,200 on a total amount of 15 times, such as the attached Table 2 of the List of Crimes.
3. The Defendant who attempted to commit fraud shall be Incheon around 00:47 on July 11, 2018.
