피고인은 2019. 5. 8 18:35경 대구 달성군 B에 있는 C 편의점 편도 1차로에서, 피고인의 에쿠스 차량이 앞서고, 그 뒤를 피해자 D의 QM6 차량이 뒤따르며 주행하던 중에 피해자가 경적을 울리고 전조등을 깜빡인다는 이유로 길 가장자리에 차량을 정차하고 차량에서 내린 후 양손으로 피해자의 가슴 부위를 1회 밀쳐 피해자를 폭행하였다.
