Reasons
1. Basic facts
A. Defendant C is a party’s position. Defendant C is a party’s position: the 1st underground floor located in Dongdaemun-gu Seoul Metropolitan Government; the 5th floor building of reinforced concrete structure; the 5th floor neighborhood living facilities and office buildings; the 1st and 4th floor; the 5th floor 9.00 square meters; the 5th floor 9.00 square meters; the 27.00 square meters of a rooftop; the 266.70 square meters of a ground floor (in the case of the 5th floor, the 1st floor, the 2,3,4th floor office; and the 5th floor reinforced concrete structure (hereinafter “instant building”).
Defendant B is a person holding the instant building, and Defendant B is a cafeteria mutually named “E” (hereinafter referred to as “instant cafeteria”) by leasing part of the instant building from Defendant C.
(2) On January 10, 201, the Plaintiff visited the instant restaurant to provide meals with the scams (hereinafter “instant stairs”) around 19:00 on January 10, 201, and was suffering from an accident of causing injuries by digging away from the stairs connected under the ground of the instant building (hereinafter “instant stairs”).
B. At the time of the occurrence of the instant accident, the instant building was located on August 6, 1981, and the registration of the ownership transfer of Defendant C’s name was completed on August 20, 1981. (2) At the time of the occurrence of the instant accident, the structure and current status of the instant restaurant were as follows. (A) At the entrance of the instant restaurant, the instant restaurant was located on the right side of the first floor of the instant building. If the instant restaurant entered a passage of about 6-7 meters from the entrance of the instant restaurant, the toilets were located at the end of the passage, and there was a door (such as a door on which the trade name was written) going to the upper upper upper floor, and the instant restaurant was located on the left side of the instant restaurant, followed by the passage of the instant restaurant. (b) At the end, the instant restaurant was opened to the extent of 10m of the length, which is the front section.
