A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. On April 11, 2019, around 23:40, the Defendant attempted to larceny a structure at night, and intruded into a kindergarten through the second floor window, where the fence of the building is opened and is going up, with the intent to steals property, in the “D kindergarten” operated by the victim C, located in Sejong Special Self-Governing City. However, the Defendant attempted to commit an attempted offense by operating the warning system of the said kindergarten, thereby spreading the warning system to the victim.

From that point to May 2019, the Defendant attempted to steal the victims’ property by intrusioning upon a structure managed by the victims 13 times at night, as shown in the annexed crime sight table Nos. 1 to 13 during the period from around 13, 2019.

2. 야간건조물침입절도 피고인은 2019. 5. 하순경 22:00부터 02:00까지 사이의 시각에 세종특별자치시 E에 있는 피해자 F이 관리하는 ‘G’에 이르러, 열린 대문을 통하여 절에 침입한 뒤 계속해서 대웅전 건물의 열려있는 문을 통해 안으로 들어가 대웅전 중앙에 놓여있던 불전함에 든 피해자가 관리하는 시줏돈 30,000원을 불전함을 기울인 뒤 준비해 간 철사를 이용하여 긁어내는 방법으로 꺼내어 들고 갔다.

피고인은 그때부터 2019. 6. 3.까지 사이에 별지 범죄일람표 연번 14부터 17까지 기재와 같이 모두 4회에 걸쳐 야간에 피해자들이 관리하는 건조물에 침입하여 합계 350,000원의 시줏돈을 절취하였다.
