Reasons
Punishment of the crime
1. On February 2, 2012, the defrauded Co., Ltd. notified E employees of the Victim Co., Ltd of the details of the contribution contract that “The Defendant would complete the agreement with the actors on the amount of contribution and directly pay the amount of contribution,” while taking charge of the production of musical performance as planned by the Victim Co., Ltd.
On February 9, 2009, the Defendant and the Victim Company entered into a contract for the production of musical performance performance (hereinafter “instant contract”) with the production agency fee of KRW 47 billion, including the contribution fee for the actors, based on the content of the said contract.
However, even though the defendant entered into a contract with F and 5 million won of the actual distribution, the defendant's notification of the victim was written in the sum of 35 million won of the contribution to 34 members such as F and 34 members, such as F, etc., as stated in the list of crimes.
Nevertheless, the Defendant concluded the instant contract on the basis of the details of the contribution contract that was falsely notified as above and acquired the above KRW 35 million by fraud after receiving all payment of the above KRW 47 million until April 5, 2012 according to the said contract.
2. After the conclusion of the instant contract, the Defendant forged the contribution contract, which was demanded by the victim to send the details of the settlement from the victim, with the intent to conceal the amount claimed in falsity.
Of April 2012, the Defendant drafted a contribution contract with 15 women's religious tables by using a computer at the Defendant's house of Seocho-gu Seoul Metropolitan Government (1304), and attached I's signature to the name, address, and resident registration number to the lower end of the contract, stating the phrase, purpose of the contract, etc. that "I enter into a contract with respect to the contribution of musical performances by 15 women (hereinafter referred to as "A") and I (hereinafter referred to as "B") as follows," and attaching I's name, address, resident registration number to the lower end of the contract.
