A defendant shall be punished by imprisonment for two years.

Punishment of the crime

[207] On August 3, 2020, at around 20:50, the Defendant was required to comply with a drinking test by inserting the whole in a drinking measuring instrument three times from around 21:09 to 21:50 on the following grounds: (a) on August 3, 2020, the Defendant was in compliance with the demand for a drinking test by inserting it into a drinking measuring instrument for three times from around 21:09 to 21:19 on the same day; and (b) the Defendant was required to comply with the drinking test by inserting it into a drinking measuring instrument for three times at the front of the place where the driver was in charge of drinking.

Accordingly, the defendant violated Article 44 (1) or (2) of the Road Traffic Act not less than twice.
