Punishment of the crime

[2014Gohap329] Defendant A is a person registered as a preliminary candidate for a G political party in the Gangseo-gu Busan Metropolitan Council member's election held on June 4, 2014.

No one shall post any wreath, balloon, signboard, placard, advertising balloon, advertising balloon, other advertising towers, or advertising facilities, except those prescribed by the Public Official Election Act, in order to influence the election from 180 days before the election day to the election day, and no one shall conduct an election campaign using advertising facilities, tools, etc., except those prescribed by the Public Official Election Act, prior to the election campaign period.

1. On April 4, 2013, around 13:52, Defendant A posted a plastic sign (a 100cm x 100cm x 100cm) on the ground floor to ensure that the electors who pass through the place can easily see it at the center of the road at the Gangseo-gu Busan Metropolitan Government H-gu H building, by setting up it on the ground floor so that they can easily see it.

2. On April 10, 2013, Defendant A posted plastic signboards (a) on the same place as “G political party, Busan City Preliminary Candidate FI No. 1, Gangseo-gu, Busan City Preliminary Candidate F. A” (a) in the same manner as “A” (a) x 100cm x 100cm cm x 100cm m, ESD lighting, etc.).

3. On April 11, 2013, Defendant A posted a signboard, such as the foregoing paragraph (1), at the same place as in the same manner, at around 18:44.

As a result, Defendant A posted publicity materials that are not subject to the Public Official Election Act in order to influence the election from 180 days before the election day to the election day, and at the same time made election campaigns by means other than those prescribed in the Public Official Election Act before the election period.

[2014Gohap433] Defendant B registered each of the preliminary candidates as the head of Gangseo-gu Office of the G Political Party, Defendant C, D, and A as members of the Busan Metropolitan City Council (Gangmun-gu F) in the simultaneous local elections conducted on June 4, 2014. Of this, Defendant B, C, and A are G parties.
