A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
Except as otherwise expressly provided for in any other Act, no one shall transfer the means of access used in electronic financial transactions.
Nevertheless, around November 29, 2012, the Defendant opened a national bank account (Account Number D) in the name of the Defendant, the representative of the Defendant, at the Silsan branch of the National Bank of Yeongdeungpo-gu Seoul Metropolitan Government, U.S. 6, 216-20, and then transferred the means of access to financial institutions by providing the passbook and cash card to those who are not aware of the names of the above account before the above bank.
No one shall transfer any means of access used in electronic financial transactions, unless otherwise expressly provided for in any other Act.
Nevertheless, around November 29, 2012, the Defendant transferred the means of access by financial institutions six times from November 27, 2012 to March 21, 2013, as indicated in the attached list of crimes, to a person who is not aware of the name of passbook and cash card in the above bank after the Defendant opened a foreign exchange bank account in the name of stock company E, a representative, at the Dong branch of the foreign exchange bank located in Yangcheon-gu Seoul Metropolitan Government.

1. On March 12, 2012, the Defendant violated the Military Service Act, who was called as a public interest service personnel and served at the G Care Center, was absent from work without any justifiable reason for at least eight days from February 1, 2013 to the 13th day of the same month, and was absent from work without any justifiable reason.
2. No person who violates the Electronic Financial Transactions Act shall transfer a means of access used in electronic financial transactions unless otherwise specifically provided for in any other Act;
Nevertheless, on November 26, 2012, the defendant opened a new bank account (Account Number: H) in the name of the defendant, a representative, in the Yeongdeungpo-gu Seoul Metropolitan Government Yeongdeungpo-dong 4-dong 57, Yeongdeungpo-gu, Yeongdeungpo-gu, Seoul, and then opened the said bank account.
