1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. On January 13, 1989, the defendant Gap, who was the owner of 89,473 square meters of G forest land in Namyang-gun, Namyang-gun (the administrative district was changed on January 1, 1995, and the land division was 44,871 square meters of F forest land in Nam-si, Namyang-si, Namyang-si, due to the division of land on May 22, 2007, and hereinafter "the land in this case"), was the owner of the land in this case, on January 13, 1989, the Jeju Mutual Savings and Finance Company (the State Mutual and Finance Company No. 1) registered the creation of superficies (the debtor Eul; hereinafter "the first mortgage in this case") and the registration of the establishment of superficies (the ownership and scope of the building and structure of reinforced concrete building: the whole land, the duration of the land from January 13, 198 to 30 years, and the mortgage creation of the superficies in this case was registered as the debtor No. 3097.
B. On June 3, 1992, Defendant A completed the registration of the transfer of ownership in the name of the Plaintiff on the part of 51,724/89,473 shares out of the instant land in Seoul Liart Co., Ltd. (hereinafter “Seoul Liart”), and Seoul Liart completed the registration of the transfer of ownership in the name of the Plaintiff’s bank from August 5, 1992 to March 18, 1994 with respect to the said shares.
C. On March 5, 1993, the object of the right to collateral security No. 3 of this case was 51,724/89,473 shares out of the land of this case, and the alteration registration of the right to collateral security was completed on March 5, 1993.
State Mutual Savings and Finance Company No. 3 applied for voluntary auction on December 16, 1996. The Korea Asset Management Corporation (Korea Asset Management Corporation) transferred No. 4 through No. 12 on December 12, 1996 to the Government branch of the Seoul District Court. The Korea Asset Management Corporation (Korea Asset Management Corporation) applied for voluntary auction on the basis of the above collateral security.
