1. The Defendant’s KRW 72,387,945 for the Plaintiff and KRW 36% per annum from July 3, 2001 to June 29, 2007.
Reasons
1. On December 9, 2005, the Plaintiff filed a lawsuit against the Defendant seeking a loan of KRW 70,000,000 and interest or delay damages thereon with the Seoul Western District Court. On July 3, 2004, the Plaintiff was sentenced to the judgment that “the Defendant shall pay to the Plaintiff the amount equivalent to 36% per annum from July 3, 2004 to the day of full payment.” The above judgment became final and conclusive.
The lawsuit of this case brought by the Plaintiff for the interruption of extinctive prescription of claims based on the above judgment has the interest in the lawsuit.
