1. The defendant shall be punished by imprisonment for eight months;
2.Provided, That the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive;
Reasons
Punishment of the crime
◀2013고단1120 피고인은 2013. 1. 18.경 청주시 흥덕구 C에 있는 D 피씨방에서, 피해자 E이 인터넷 사이트 네이버의 ‘F’에 올린 뉴아이패드를 구매한다는 글을 보고 피해자 E에게 연락하여 위 뉴아이패드를 42만 원에 판매하겠다고 거짓말을 하였다.
However, the defendant did not have any intention or ability to sell the said New Zealand to the victim E.
As such, the Defendant, by deceiving the victim E as such, received 420,000 won on the same day from the victim E to the national bank account under the name of the Defendant for the consideration of goods, as well as from around that time to April 25, 2013 a list of offenses in the above manner.
1. The victims received a total of KRW 4,230,000 in total as the price for goods once every 11 times as described;

1. On November 18, 2012, the Defendant, at the Defendant’s residence located in Cheongju-si, Cheongju-si, Cheongju-si, issued a false statement to the effect that the Defendant: (a) the Victim H purchases the arches posted on the “F” of the Internet website; and (b) contacted the Victim H with the victim H, thereby selling the POs in KRW 100,000.
However, the defendant did not have any intention or ability to sell the above aide to the victim H.
As such, the Defendant, by deceiving the victim H, received KRW 100,000 on the same day from the victim H to the Agricultural Cooperative Account under the name of the Defendant for the consideration of goods, and received KRW 100,000 on the same day from around that time to April 21, 2013, as well as by the foregoing method.
2. A total sum of KRW 2,30,000 was remitted from the victims nine times in total as the price for the goods.
2. Violation of the Act on the Promotion of Utilization of Information and Communications Network and Information Protection, Etc. (Violation of Information and Communications Network, etc.) is known to the Defendant during the period from March 1, 2013 to May 12, 2013 at or near the residence of the said Defendant, and at an opportunity to be informed of the same.
