1. The Defendant shall pay to the Plaintiff KRW 40,474,00 and the interest rate of KRW 15% per annum from March 1, 2017 to the date of complete payment.
Reasons
1. Facts of recognition;
A. From May 1, 2016 to June 15, 2016, the Defendant received recommendation from the Plaintiff for the daily workers required for performing construction works at each construction site in urban renewal acceleration districts B, C, D, and E, but the Plaintiff settled daily labor costs of the relevant daily workers, while the Defendant calculated monthly labor costs of the daily workers and calculated monthly labor costs to the Plaintiff.
B. On June 17, 2016, the Defendant prepared and sent to the Plaintiff a document stating the following:
1) Construction site: 106,934,30 won in total labor cost in the construction site other than B urban renewal acceleration district: The plaintiff arranged the defendant for a construction-day worker, and directly paid the worker's wages on behalf of the defendant with the defendant's approval. At present, it is confirmed that the defendant's obligation remainder amount for May 2016 is the above total labor cost (106,934,300 won) and the obligation to pay the plaintiff. The defendant consented to pay the plaintiff with the labor cost of the construction-day worker on behalf of the defendant, and confirmed that the plaintiff paid the whole labor cost (106,934,300 won) directly to the construction-day worker. It is promised to pay the plaintiff with the total labor cost in the construction site: B urban renewal acceleration district: 38,175,00 won in total labor cost to the defendant and paid the worker's wages directly on behalf of the defendant with the defendant's approval.
At present, I confirm that the defendant's balance of debt on June 2016 is the above total labor cost (38,175,000 won) and the obligation to pay to the plaintiff.
The defendant consented to the plaintiff to pay the labor cost of the construction worker on his behalf, and confirmed that the plaintiff paid the total labor cost (38,175,000 won) directly to the construction daily workers.
Accordingly, I promise to pay the Plaintiff the total labor cost.
3. Construction site: The Plaintiff shall be the total labor cost of KRW 7,760,000.
