1. The Defendant: (a) KRW 25 million to the Plaintiff; and (b) 5% per annum from July 3, 2015 to January 19, 2016 to the Plaintiff.

Reasons

1. Basic facts

A. On July 22, 2014, the Plaintiff filed a criminal complaint against B, a licensed real estate agent, against B on July 22, 2014. On August 26, 2014, the Plaintiff was prosecuted as Busan District Court Decision 2014Hau7021.

(2) B was convicted on May 14, 201 on the ground of the fact that, upon being delegated by the Plaintiff to enter into a monthly rent lease contract of 30 million won for the monthly rent deposit of 30 million won and 5 million won for the monthly rent deposit of 25 million won for the difference between the Plaintiff and the actual payment of 30 million won for the following reasons: (a) in violation of the above occupational duties, B was found guilty on May 14, 201 (hereinafter “instant criminal judgment”); and (b) on December 18, 2015, the said judgment became final and conclusive on December 18, 2015, by having the Plaintiff enter into a lease contract of 30 million won with the lessee D.

(3) In the instant criminal case, the Plaintiff filed an application for a compensation order against B on September 15, 2014 (No. 2014 early 3134) with respect to the instant criminal case, and received a compensation order with the purport that “B shall pay the Plaintiff KRW 25 million of the damages caused by breach of trust.”

B. The Defendant entered into a mutual aid agreement with B and a real estate broker which guarantees liability for damages to the parties to the transaction by intentionally or negligently causing damage to their property while acting as a real estate broker (hereinafter “instant mutual aid agreement”).

Part of the terms and conditions of the above mutual aid contract shall be as follows:

Article 7 (Compensation for Non-Compensation)

5. The prohibited act of a broker under Article 33 of the Business Affairs of Licensed Real Estate Agents and Report of Real Estate Transactions Act (hereinafter “Act”).
