A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

On June 29, 2019, around 01:25, the Defendant, within the “C main point” located in Guri-si B, performed drinking together with the victim D (years 54) who worked and became aware of in the same company prior to the towing.

피고인은 피해자와 대화를 하던 중 피해자가 손으로 자신을 툭 쳤다는 이유로 화가 나 갑자기 자리에서 일어나 주먹으로 피해자의 얼굴 부위를 약 3회 때리고, 이를 피하기 위해 피해자도 자리에서 일어나자 테이블에 놓여있는 위험한 물건인 유리 맥주잔을 피해자의 얼굴 부위를 향하여 집어던져 위 맥주잔을 피해자의 오른쪽 어깨 부위에 맞추고, 피해자를 밀쳐 넘어뜨린 다음 테이블에 놓여있는 위험한 물건인 유리 맥주잔을 넘어져 있는 피해자의 얼굴 부위를 향하여 집어던져 위 맥주잔을 피해자의 좌측 눈썹 윗부분에 맞췄다.

계속하여 피고인은 바닥에서 일어나 비틀거리며 피고인에게 다가오는 피해자의 멱살을 양손으로 잡아 밀치고 피해자를 속칭 ‘엎어치기’ 방식으로 바닥에 넘어뜨린 후 발로 피해자를 1회 걷어찼다.

Accordingly, the Defendant carried dangerous goods as above and inflicted injury on the victim, such as the left-hand eyebrow face, which requires medical treatment for about 14 days.
