Reasons

Punishment of the crime

The defendant, as the representative of C in Edsan City, is an employer who runs a crop cultivation business using four full-time workers.

1. When a worker dies or retires, an employer in violation of the Labor Standards Act shall pay him/her wages, compensations, or other money or valuables within 14 days after the cause for such payment occurred;

Provided, That in special circumstances, the date may be extended by mutual agreement between the parties.

Nevertheless, the Defendant did not pay KRW 1,300,00 for April 18, 2015 to November 14, 2016, the amount of KRW 1,30,000 for work as a farm in the said place of business, the monthly wage of KRW 100,00 for August, 200, the amount of KRW 200,00 for September portion, the amount of KRW 1,300,00 for September portion, the amount of KRW 1,300 for October portion, and the amount of KRW 1,30,00 for November portion, and the amount of KRW 5,240,00 for November portion, without agreement between the parties on the extension of the payment date.

2. An employer who violates the Guarantee of Retirement Benefits of a worker, shall pay a retirement allowance within fourteen days after the cause of payment thereof occurs, in case where the worker retires; and

Provided, That the payment date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the defendant did not pay KRW 1,585,318 of the above worker D's retirement pay within 14 days from the date of retirement without any agreement on the extension of the payment deadline between the parties.
