1. The Defendant shall pay to the Plaintiff KRW 23,276,00 and the interest rate of KRW 12% per annum from November 22, 2019 to the date of full payment.
Reasons
1. Facts of recognition;
A. On March 14, 2016, the Plaintiff entered into a lease agreement (hereinafter “instant lease agreement”) with the Defendant to lease the entire facilities in both C and six parcels, and the general restaurants located on the land, including C, with a deposit of KRW 80 million, and the monthly rent of KRW 4,200,000 (including value-added tax) for five years from the date of the contract, and to increase the monthly rent at the rate of KRW 15% every two years (hereinafter “instant lease agreement”).
B. The Defendant paid the deposit to the Plaintiff around March 2016, and operated the business in the above restaurant from that time.
However, the Defendant paid 2 million won out of the monthly rent for October 2, 2017 on or around January 2, 2018, and did not pay that monthly rent thereafter. Around August 26, 2018, KRW 6 million was paid around September 12, 2018, KRW 6 million around September 21, 2018, and KRW 3 million around November 21, 2018, and did not pay that monthly rent.
C. On December 3, 2018, the Plaintiff sent to the Defendant a certificate that the instant lease contract is terminated on the grounds of the delinquency in rent. On November 21, 2019, the Defendant delivered the said business site building, etc. to the Plaintiff around November 21, 2019 during the instant lawsuit.
The details of the rent that the Defendant failed to pay to the Plaintiff until the delivery of the building, etc. of the above place of business (However, the payment made after August 26, 2018 was not reflected) are as follows. Upon the Defendant’s request, the Plaintiff paid 3.5 million won of the unpaid electricity charge around December 22, 2016 and 100,000 won of the cleaning cost of the septic tank around July 31, 2018.
