1. The instant lawsuit shall be dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. Defendant B shared shares of 1653/12496, Defendant C’s 1653/12496, Defendant D’s 2314/12496, Defendant E’s 1322/12496, Defendant F (open G)’s 1653/12496, Defendant H 2248/12496, and JJ shared shares of 1653/12496.
B. On September 17, 2015, J, Defendant B, and E filed a lawsuit against Defendant C, D, H, and F (after the opening of the name), seeking a partition of co-owned property on the instant land under the Youngcheon District Court’s Young-gu Branch 2015Kadan11545, and on June 20, 2016, conciliation was established between the parties as follows.
1. Of the instant land
A. Annex 2. Annex 1. Annex 2. Annex 2. Annex 2.0m2,07m2,00 square meters in line with each point of Annex 1,11, 33, 32, 31, 17, 16, are owned by Defendant H;
(b)in the order of 1,485 square meters in part 1,485 square meters in the ship connecting each point in the same drawings Nos. 17, 31, 30, 21, 20, 19, 18, and 17, the same drawings shall be owned by J;
(c)the portion of 1,129 square meters on board which connects each point of 30,29,24,22,21,30 square meters in sequence of the same drawing indication is owned by Defendant E;
(d)the section 1,411 square meters of the ship connected to each point of 29,28, 27, 26, 25, 24, and 29, indicated in the same drawing, are owned by Defendant F (G).
(e)the portion 2,154 square meters in the ship connecting each point in order to indicate 11,2,3,12,35,34,33, and11 of the same drawing is owned by Defendant D;
(f)the portion of 1,485 square meters on board which connects each point of 35,12,13,36,35 of the same drawing indication is owned by Defendant C;
(g) Division 1,270 square meters in proportion to each point of 36, 13, 4, 5, 14, 37, and 36 of the same drawing is divided into the part of 77 square meters in the ship connecting each point, respectively, owned by Defendant B;
2. In the case of the instant land, the part 458 square meters connected in order to each point of the attached Table 2. 16 through 23, 15, and 16, among the land in this case, shall be as shown in attached Table 3. The portion of co-ownership shares indicated in attached Table 1. The part 1,025 square meters in the ship connecting each point of the same section in attached Table 15, 23, 22, 24 through 37, 14, 6, 7, 8, 9, 10, and 15 shall be as indicated in attached Table 2. The defendants and J shall be as indicated in attached Table 3. 2.
