The decision made by the Intellectual Property Tribunal on December 5, 2014 on the case No. 1993 shall be revoked.
The costs of lawsuit are assessed against the defendant.
Reasons
1. Basic facts
A. The name of the Defendant’s invention of this case (Evidence A2 through 4) 1: C2; the filing date (the filing date of the priority right); the registration date/patent number: Claims (E) (E) (11) (the correction request for correction was reflected in December 11, 2013): the Defendant corrected “a mixture of “a mixture between 1 to 3 for sale” as “a mixture of 1 to 3 for sale” in the entries in (hereinafter referred to as “corrections 1”) as “a mixture of 1 to 3 for sale” (hereinafter referred to as “corrections 1”).
(2) Of the claims, the correction was made to delete paragraphs 2 through 5 (hereinafter “Correction Claim Nos. 2”) while limiting the types of the paper No. 1 through 3 and the content of the paper No. 1 among the paper No. 1 to 3.

(3) The lower court determined that the lower court erred by misapprehending the legal principles on the following facts: (a) the lower court did not err by misapprehending the legal principles: (b) the lower court did not err by misapprehending the legal principles as to whether the lower court did not err by misapprehending the legal principles as otherwise alleged in the ground of appeal: (c) the lower court did not err by misapprehending the legal principles as to the lower judgment; and (d) the lower court did not err by misapprehending the legal principles as otherwise alleged in the ground of appeal.
