Reasons
Punishment of the crime
[criminal record] On July 7, 2010, the Defendant was sentenced to six months of imprisonment for a violation of the Narcotics Control Act at the Seoul Central District Court on October 25, 2010, and the execution of sentence was terminated on October 25, 2010. On June 26, 2012, the court sentenced one year and six months of imprisonment for the same crime and became final and conclusive on January 10, 2013.
【Criminal Facts】
Even if the Defendant is not a person handling narcotics, the Defendant purchased psychotropic drugs-related Metephaculty (hereinafter referred to as 'culphopon', hereinafter referred to as 'culon'), as follows:
1. On January 10, 201, the Defendant: (a) received a request and consented to the purchase of philophones; (b) transferred KRW 1,00,00,000 to the Agricultural Cooperative account in the name of the Sing E in order to purchase 50 gramphones from the upper line residing in the Singsan to purchase 15,00,000,000,000,000,000,000,000,000,0000,000,000,000,000,000,000,000,000,000 won.
After that, at around 15:00 on the same day, the Defendant received approximately 1.4g gramphonephones from E at the Defendant’s dwelling at 504 dong 503, the same day.
Accordingly, the defendant purchased approximately 1.4 grams from E in 100,000 won.
2. On January 14, 201, the Defendant purchased Handphones, around 10:00 on January 14, 201, at the Defendant’s dwelling place of 504 Dong-dong 503, the F apartment in the Suwon-si, and at the Defendant’s dwelling place of 50-dong 503, approximately 40 gram-phones packed from E in two plastic papers, and transferred KRW 5 million to the bank account in the G’s name managed by E at around 14:15 on the same day, and transferred the remainder of KRW 5 million to E’s bank account in the name of H.
Accordingly, the Defendant purchased approximately KRW 40 gramphones from E in KRW 10 million.
