Basic Facts

The plaintiff, such as the status of the parties, is an autonomous management organization that consists of occupants for the management of the 343 households of the 4-dong apartment complex A located in the Nam-gu Seoul Metropolitan City (hereinafter referred to as the "instant apartment complex").

Defendant B (hereinafter “Defendant B”) is an executor who constructed and sold the instant apartment, and Defendant C’s limited partnership company (hereinafter “Defendant C”) is a contractor who has contracted the new construction of the instant apartment from Defendant B, and the Defendant Housing and Urban Guarantee Corporation (hereinafter “Defendant Corporation”) changed its name at the Korea Housing Guarantee Company; hereinafter “Defendant Corporation”) is a guarantor who has concluded a warranty liability contract for defects after the inspection of the instant apartment with Defendant C.

On July 25, 2014, the apartment building of this case was approved for use on July 25, 201, and around that time, Defendant B fulfilled its duty to transfer each of the ownership of the apartment of this case to the buyer.

On July 25, 2014, Defendant C entered into a warranty contract for the new construction of the instant apartment (hereinafter “each guarantee contract of this case”) with a guarantee creditor set as stated below with Defendant Corporation and the head of Nam-gu Seoul Metropolitan City as the guarantee creditor, and entered into a warranty contract for the new construction of the instant apartment (hereinafter “each guarantee contract of this case”).
