A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a seller (a store) who sells obscene videos from the web hard site “B”.

[The role of the web hard site operator and members] The "weld site" is classified as operator, seller (or trader), buyer (or trader), and each of them' roles are as follows.

① An operator is a person who constructs a storage space for electronic information (hereinafter referred to as “dynamic video file, etc.”) on the web hard site server, allowing its members to store “dynamic video files, etc.” (hereinafter referred to as “business page”) on the “weld website server,” or provides its members with services that can store “dynamic video files, etc.” stored in the “weld website server” (hereinafter referred to as “weld”) on their personal computers.

② A seller is a member of the web hard site, and (i) a person who runs the same image files, etc. in the “weld website server,” which was set up by the operator as described in the above (ii).

③ The buyer (c) is a member of the web hard site, and (2) as set forth in the above, a seller runs the “weld website, etc.” to “weld the video files, etc.” which he/she opened to the “weld website.”

[Form of Benefit Creation by Web Tradrror] In order to collect a “dynamic image file, etc.” from a web ladr site, the buyer(s) shall pay money to the operator and purchase points, and then pay these points to the seller(s).

In addition, the seller(s) may pay a certain percentage of the fee to the operator and exchange the fee in cash with the points received from the buyer(s) as above.

Accordingly, the operator and seller of the web hard site will make profits.
