A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. From July 2012 to July 5, 2012, the Defendant: (a) from around 501, the “F” in the name of “F”; (b) the said business was not relieved of deficit, such as having been paid KRW 20,000 per month only for operating expenses such as office rents; and (c) at the time the Defendant’s personal debt was paid KRW 20,000,000 per month by interest to KRW 20,000 per month; and (d) even if having received an investment from others, there was no intent or ability to pay the proceeds as agreed, because it should appropriate the money to repay the debt.
Nevertheless, the Defendant would return the principal to the victim Y within six months and pay the dividend of 8% per month at the F's office in July 2012 to the victim Y.
The phrase “ makes a false statement.”
The Defendant received KRW 10,00,000 from the injured party as investment money at the time of the above day, as well as from July 2012 to October 8, 2013, a total of KRW 165,00,000 from the victims during nine times in total, as shown in the list of crimes in the attached Table of Crimes.
Accordingly, the defendant was informed of the victims to receive property.
2. No person who violates the Act on the Regulation of Similar Receiving Acts and subordinate statutes shall receive contributions from many and unspecified persons under an agreement to pay the total amount of contributions or an amount in excess thereof in the future without obtaining authorization therefor, obtaining registration thereof, or filing a report thereon, etc.;
Nevertheless, the Defendant would return the principal within six months and pay dividends of 8% per month to Y, as described in paragraph 1, at the F Office of “F” as described in paragraph 1, which was written in July 2012, without obtaining authorization from the law or filing for registration, etc.
“Investment”, from July 2012 to October 8, 2013, as well as from the receipt of KRW 10,000,000 from the above temporary Y for investment purposes.
