The appeal is dismissed.

The grounds of appeal are examined.

For the reasons indicated in its holding, the lower court rejected the Defendant’s appeal claiming a misunderstanding of facts against the first instance judgment which found the Defendant guilty of the facts charged of this case, and upheld the first instance judgment.

The allegation in the grounds of appeal is merely an error of the fact-finding by the fact-finding court in accordance with the principle of free evaluation of evidence, and even if the grounds alleged in the grounds of appeal are examined in light of the evidence duly admitted, it did not err by failing to exhaust all necessary deliberations

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
